The Equal Justice Party (EJP) ID 22403 was unlawfully assessed an excessive penalty of $3600 for an alleged delinquent filing of the March 2016 Quartely report (16 MQ 135).
EJP never received notice of the Board's complaint's or hearings. The Board had the wrong address or no address at all, which represents a due process violation of EJP.
The first EJP became aware of any fines and penalties was in March 2017. EJP filed an Appeal. On March 27, 2017 the Director Tom Newman wrote EJP a letter informing EJP that its appeal was untimely. Based upon the law and the facts of this case. EJP's appeal was not untimely. The State Board of Elections never served any proper notice on EJP.
EJP is making a good faith effort and attempting to exhaust all of its administrative remedies, prior to filing suit against the Illinois State Board of Elections and it's Board Members, Director
EJE requests that the State Board of Elections re-open the Appeal process for EJE and permit the EJE Appeal to proceed.
